New York’s Sexual Assault Civil Laws & Filing Deadlines
New York has changed its civil statutes of limitations significantly over the past several years, and those changes affect what options are available to survivors right now. Understanding which law applies to your situation is one of the first things we work through together.
Child Victims Act
New York’s Child Victims Act extended the deadline for survivors of childhood sexual abuse to file civil claims until their 55th birthday. Previously, most survivors lost the right to sue at age 23. This change opened the door for many adults to pursue claims for abuse that occurred decades earlier.
2019 Statute of Limitations Extension
In 2019, New York extended the civil statute of limitations for certain adult sexual assault felonies to 20 years. This extension applies going forward but was not retroactive for abuse that occurred before the change took effect.
Adult Survivors Act
New York’s Adult Survivors Act created a one-year lookback window, open from November 24, 2022, through November 24, 2023, that allowed previously time-barred adult sexual assault claims to be filed regardless of when the abuse occurred. That window has since closed.
NYC Gender-Motivated Violence Act Lookback Window
New York City’s Gender-Motivated Violence Act was amended effective January 29, 2026, opening a new 18-month civil lookback window for gender-motivated violence claims, including sexual assault, that occurred before January 9, 2022. This window is open through approximately July 29, 2027, and the amendment explicitly allows claims against institutions that enabled or covered up the violence. Outside lookback windows, Gender-Motivated Violence Act claims generally carry a seven-year filing period, with some claims extending to nine years under certain conditions. Deadlines can change, and survivors should confirm current timelines with an attorney before drawing any conclusions about whether a claim is still available.
